L’affaire « Steve Amoussou » n’a pas fini de livrer le dernier épisode. Après son arrestation le 12 août dernier dans la capitale togolaise et présenté au procureur spécial de la Criet le 28 août puis déposé en prison le même jour, Steve Amoussou a porté plainte contre ses ravisseurs pour violation de ses droits humains. Ce mardi 03 septembre 2024, trois des quatre ravisseurs identifiés par le procureur de grande instance de Lomé ont comparu devant la cour spéciale. À la grande surprise de tous, deux accusés ont été reconnus coupables et condamnés à 24 mois d’emprisonnement dont 12 mois ferme et doivent payer 5 millions de francs Cfa à Steve Amoussou pour dommages et intérêts. Quant au troisième prévenu qui n’est rien d’autre que le Directeur du Centre National d’Investigation Numérique (Cnin), Ouanilo Médégan Fagla, a été purement et simplement relaxé au bénéfice du doute.
Un procès simulacre à un spectacle de théâtre
Le procès des ravisseurs de Steeve Amoussou fait planer moultes questionnements quant à la sincérité de la justice béninoise dans cette affaire. Lors de l’audience de ce mardi, Jimmy Gandaho et Géraud Gbaguidi, les deux prévenus condamnés, auraient déclaré que Ouanilo Médégan Fagla n’a pas effectué le déplacement avec eux à Lomé pour le Kidnapping de Steve Amoussou. À en croire l’un d’entre eux, ils y étaient allés avec deux “petits” du quartier. Un argument qui sera renforcé par le plaignant lorsque ce dernier affirme n’avoir pas vu Ouanilo Médégan Fagla lors de son arrestation. Invraisemblablement, le blanchiment de Ouanilo n’est qu’une manière de dédouaner l’État béninois dans cet acte qu’il convient de qualifier de voyoucratie. Puisque ce dernier dirige le Cnin qui est une institution publique de l’État et sa culpabilité sera synonyme de l’implication directe de l’État béninois dans cette opération. Mais, si tant est que Ouanilo n’était pas avec l’équipe de Mma dans le pays de Faure Gnassingbé, où sont passés donc les deux autres ravisseurs ? Le procureur de la Criet a-t-il cherché à identifier les deux autres en fuite à travers Gandaho et Gbaguidi ? Si l’arrestation de Steve Amoussou est illégale, la justice ne devrait-elle pas relaxer Steeve Amoussou pour montrer son indignation de cette opération injuste et sans aucun fondement juridique ? Autant de questions qui font dire à certains citoyens que ce procès est simulacre à un spectacle de théâtre.
Les mandats d’arrêt internationaux du Togo, sans effets ?
L’autre préoccupation qui taraude des esprits est, les mandats d’arrêt internationaux lancés par le Togo contre les quatre ravisseurs. Même si le droit béninois ne permet pas à l’État d’extrader ses citoyens dans un autre pays, la justice du Bénin devrait coopérer avec sa consœur du Togo afin que les mis en cause soient extradés pour répondre des chefs d’inculpation retenus contre eux. En se faisant, la justice montrera son engagement à élucider cette affaire ignoble et à laver son honneur. Sinon, le Togo pourrait, comme l’estiment certains hommes de droit, lancer des mandats d’arrêts internationaux contre les autorités judiciaires du Bénin pour complicité.
De toute évidence, le verdict rendu par la Criet n’annule pas les mandats d’arrêt à l’encontre des deux condamnés, ni Ouanilo encore moins le quatrième qui reste pour le moment introuvable. Le procès du 07 octobre prochain nous édifiera davantage.
